Article 2 Applicability & Conditions

The general terms and conditions apply to every offer from me as a web retailer to you as a consumer (any natural person who acquires or uses products or services exclusively for non-professional purposes). To place an order, you must be at least 18 years old. If you are under 18, I ask you to have your parents or legal guardian place the order. If I become aware that an order has been placed by a minor, I may refuse the order. Placing an order on the website constitutes explicit acceptance of the general sales conditions, which are always available on the website. If the general terms and conditions conflict with the specific terms and conditions, you, as the consumer, can always invoke the most favorable text in your favor.

Article 3 My Offer and Your Order

If an offer has a limited validity or is subject to certain conditions, I will explicitly mention this in my offer. I always describe the products and the ordering process as fully and accurately as possible. The description is sufficiently detailed to allow you to make a proper assessment. If I use images, they are a true representation of the goods and/or services offered. The colors/textures of the wood may slightly vary from the photo as each piece of wood is unique. Your order is complete and the agreement between us is final once I confirm your order by email and once I have received approval from the card issuer for your payment transaction with credit or debit cards. I accept Visa, Mastercard, Maestro, Bancontact, and Paypal. If the card issuer refuses to authorize the payment to me, I cannot be held responsible for any delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed. To purchase a product, you add it to your shopping cart. Then you provide your contact and billing information. Next, you choose your delivery method: delivery to a home address, delivery to an office, or pick-up at Mandiau Jewellery (by appointment only). In the final step, you will see an overview page, where you accept our terms and conditions and confirm your payment by clicking the order button with the caption "order with payment obligation". Once you have completed these steps, your purchase is final.

Article 4 Right of Withdrawal

If you purchase goods or services from me, you have the right to decide that you do not wish to keep the goods within 14 days from the delivery or conclusion of the agreement. You can return your order without paying a penalty and without stating a reason (you will be responsible for the return shipping costs). Within 14 days after I have received your returned order or you have indicated that you wish to withdraw from the agreement, I will refund you the full purchase price using the same payment method you used for the initial transaction. The direct costs of returning the goods will be borne by you. I will indicate the cost of returning the goods or provide an estimate if it cannot be reasonably calculated in advance. I may withhold the refund until I have received the goods or until you have provided proof of returning the goods, whichever occurs first. During the first 14 days after the delivery, I expect you to handle the order and packaging with care. If you wish to return the goods as described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep them. Returned goods must be in a fitting condition and should not have been used. When returning the goods, please include the original packaging and ensure they are returned in their original condition and packaging, following my instructions provided below. You can return your package via mail or courier service. To exercise your right of withdrawal for goods delivered quickly and accurately, you can fill out the form below and send it to Pieter Breughellaan 23 1861 Wolvertem or info@mandiau.com. I will send you a confirmation of receipt for your withdrawal by email.

Article 5 The price

During the period mentioned in my offer, my prices do not change, except for price adjustments due to changes in VAT rates. My prices include all taxes, VAT, fees, and services. So, you will never be surprised by additional costs. However, I may decide to charge shipping costs in addition to the purchase price. In that case, I will always inform you before you finalize your purchase.

Article 6 Payment

I can only accept payment through the payment gateways on my website. To ensure secure online payment and the safety of your personal data, transaction information is encrypted using SSL technology and transmitted over the internet. You don't need any special software to make payments with SSL. You can identify a secure SSL connection by the "padlock" symbol in the lower status bar of your browser.

Article 7 Conformity and Warranty

I guarantee that my goods are in accordance with your order and meet the normal expectations you may have, taking into account the specifications of the product. I also assure you that my goods comply with all applicable laws at the time of your order. Furthermore, regarding the delivery of goods, I adhere to the legally required minimum warranty period of one year if the goods are not in conformity with the placed order. This means that in case of defects or malfunctions of the goods within 1 year after delivery, they will be repaired or replaced free of charge. As far as it is possible and reasonable, you have the choice between repair or replacement. Only if repair or replacement is excessive or impossible, or cannot be performed within a reasonable timeframe, you have the right to demand a price reduction or termination of the sales agreement. If the defect or deficiency becomes apparent within 3 months after delivery, it is assumed to have already existed before the delivery, unless I can prove otherwise. After 3 months, you will have to prove that the defect was already present at the time of delivery.

Article 8 Delivery and Performance

All goods and services are delivered to the address you provided during your order. When an item is in stock, it will be delivered to your delivery address within 1 to 5 working days. I will inform you about the delivery timeframe in your order confirmation. If I am unable to deliver on time, I will always notify you before the expected delivery deadline. If I fail to do so, you have the right to cancel your order free of charge. In that case, I will refund you within 30 days after the cancellation. If you return goods to me within 14 days of purchase because you no longer wish to keep them, you are responsible for the transportation. If the goods delivered by me are damaged during transport, do not correspond to the items listed on the delivery note, or do not match the items you ordered, you must report this as soon as possible, but within 3 days, and return the items to me within 14 calendar days after receiving them.

Article 9 Duration

The consumer can terminate an agreement entered into for an indefinite duration at any time, taking into account the agreed-upon termination rules and a notice period of up to one month. An agreement entered into for a fixed term has a maximum duration of two years. If a goods agreement of a fixed term stipulates that, in the absence of a response from the consumer, the distance agreement will be extended, the agreement will continue as an agreement for an indefinite duration, and the notice period after continuation of the agreement will be a maximum of one month. In the case of a services agreement of a fixed term concluded between the company and the consumer that includes a provision for automatic renewal, this provision will be presented in bold letters and in a separate frame on the front page, apart from the text. This provision will specify the consequences of automatic renewal, including the provisions of the following paragraph regarding termination, as well as the latest date on which the consumer can object to the automatic renewal of the agreement and the method by which they can communicate this objection. After the automatic renewal of a services agreement of a fixed term, the consumer can terminate the agreement at any time without compensation, with a notice period of up to two months.

Article 10 Force Majeure

In case of force majeure, I am not obligated to fulfill my obligations. In such a situation, I may either suspend my obligations for the duration of the force majeure or terminate the agreement permanently. Force majeure refers to any circumstance beyond my will and control that wholly or partially prevents the fulfillment of my obligations. This includes, but is not limited to, strikes, fires, business disruptions, power outages, disruptions in a (telecommunication) network or connection, or the unavailability of communication systems and/or my website at any given time, non-delivery or delayed delivery by suppliers or other third parties involved, and so on.

Article 11 Intellectual Property

My website, logos, texts, photos, names, and all my communication, in general, are protected by intellectual property rights, either owned by me, my suppliers, or other rightful owners. It is prohibited to use or modify the intellectual property rights as described in this article. For example, you are not allowed to copy or reproduce drawings, photos, names, texts, logos, color combinations, etc., without my prior and explicit written permission.

Article 12 Complaints Procedure and Disputes

I make every effort to address your complaint within 7 days. All agreements I enter into with our customers, regardless of their place of residence, are exclusively governed by Belgian law, and only the competent Belgian courts have jurisdiction in case of disputes. If, for reasons of international law, another law is applicable, the interpretation of these terms and conditions will primarily refer to the Belgian Law on Market Practices and Consumer Protection.
